Terms of service

These terms apply to all orders you make at Niced Nation website and only to consumers and not retailers and other businesses.

Privacy Policy and Shipping & Returns are an integral part of these Terms of Service.

1. Orders

By placing an order and making a payment, you agree to these terms, and your order is an offer to conclude a purchase agreement. By sending you an acceptance message or ordered products, we accept your order, and the purchase agreement is concluded.

Place an order: In the online store, you can select products and add them to the shopping cart.

Fill in billing information: Provide only accurate information.

Make a payment: We will charge you at the end of the checkout process.

We will notify you: Once you have placed the order or we have shipped the products, we will send you an email.

If the product you ordered is unavailable or the shipment will be delayed, we will notify you. If you cancel the order in that case, we will reimburse all payments you have made regarding the specific order no later than within 10 business days.

2. Prices and Payments

Prices: All prices are indicated on our website and are valid at the time of your order. We may change prices at our discretion at any time, but such changes will not affect orders placed.

Prepayment: At the time of order, you must make a full prepayment for the ordered products.

Taxes: All prices include value added tax (if applicable).

Shipping costs: We will charge additional shipping costs on top of the product’s price. Shipping costs are indicated on the checkout page.

Payment methods: Our accepted payment methods are indicated on the checkout page. As we use payment processing providers, we do not see and store your payment card details.

3. Withdrawal Rights

European Union residents have the right to withdraw from the purchased products within 14 days from the delivery date (when you or another recipient indicated by you has received the products). Please follow these steps to complete the withdrawal procedure:

1) First, send us a clear statement that you are withdrawing from the product (see contacts below). The statement shall include information about the product, ordering date, purchase price, your full name, and contact information.

2) Follow our instructions and cover all costs related to the return of the products (shipping, taxes, customs, etc.).

3) Dispatch the product within 7 days of the notice of refusal. Failure to do so will result in termination of the right of withdrawal.

4) The products shall not be used and damaged. You are liable for any diminished value of the products resulting other than necessary to establish the products’ nature, characteristics, and functioning.

5) We will hold the refund until we receive the returned products. For the refund, we use the same payment method you used in the original transaction.

6) Withdrawal rights do not apply to products made under your specifications or are clearly personalized (such as non-standard size or color, engravings, etc.).

 

4. Warranty

Warranty: The warranty means that the products must be free from defects in materials and workmanship.

Time: If the product is defective, you shall make any claims within two years from the delivery date.

Product usage: The warranty covers the functionality of the products for their normal and intended use.

Our actions: In a warranty case, we will at our discretion repair the defect, replace the product, or refund the purchase price.

Limitation: the warranty does not apply to wear and tear of the products and defects or damages caused by improper use or poor maintenance.

5. Liability

Liability limitation: We are not liable to you and any third party who uses the products for indirect, special, incidental, and consequential damages.

Total liability: Unless otherwise stated by law, our maximum liability for any loss or damage arising in connection with ordered products is limited to the total price of the order.

Force majeure: We are not liable for delays and damages resulting from force majeure events.

6. Disputes

European Union consumers have the right to use an online dispute resolution platform.
If no settlement is reached, either party may submit the dispute to the courts of the Republic of Latvia.
These terms are governed and construed under the laws of the Republic of Latvia.

    7. General

    Changes: We may change these Terms of Service and other related policies at any time. All changes will apply only to future purchases. The version in force at the time of order is applicable and governs your order.

    Colors: We try to display the products and their colors accurately. However, the actual color may depend on the device you are using and its configuration.

    Intellectual property ownership: We, our affiliates, and our licensors own all right, title, and interest to all products, content, and design we offer or provide.
